Title
An Ordinance to Amend Subsection 6.01(2) of the West Allis Revised Municipal Code and to Repeal and Recreate Subsection 6.01(3) of the West Allis Revised Municipal Code Relating to Use of Bows and Arrows and Other Devices and Hunting within the City of West Allis.

The Common Council of the City of West Allis do ordain as follows:
PART I. Subsection 6.01(2) of the Revised Municipal Code of the City of West Allis is hereby amended to read:
6.01 Public Safety.

(2) Air Rifles and Sling Shots.
(a) Use Prohibited. No person shall shoot, discharge or fire an air rifle, air gun, sling shot, bow and arrow or crossbow, or any similar device within the City subject to the exception herein or in Subsection (3).
(b) Exceptions. Nothing in this section shall prevent the discharge of air rifles, air guns, bows and arrows or crossbows in private ranges or galleries constructed and maintained as required by the Department of Building Inspections and Neighborhood Services, so as not to endanger life, limb or property.
(c) Penalty. In addition to payment of the penalty prescribed in Section 6.04, each violator shall forfeit the air rifle, air gun, sling shot, bow and arrow or crossbow, or other similar device used by the violator, which device shall be confiscated.
PART II. Subsection 6.01(3) of the Revised Municipal Code of the City of West Allis is hereby repealed and recreated to read:
6.01 Public Safety.

(3) Hunting.
(a) Use Regulated.
1. The provisions of Section 6.01(2)(a) notwithstanding, a person may hunt with a bow and arrow or crossbow as provided herein. No person shall hunt with a bow and arrow or crossbow within 100 yards of a building located on another person's land. This restriction shall not apply if the person who owns the land on which the building is located allows the hunter to hunt within the specified distance of the building.
