Resolution Approving a Lease Agreement of an Off-street Parking Lot Between The City of West Allis and David R. Matuszczak.

WHEREAS, the City of West Allis is the owner of an off-street parking lot located adjacent to lots 14 and 15 and is a part of lots 13 and 16, Block 10, Otjen, Pullen & Shenner's Subdivision; and,
WHEREAS, David R. Matuszczak entered into a lease for said parking lot on September 6, 2000; and,
WHEREAS, David R. Matuszczak used said parking lot without paying the required fees for the years 2001-2002 and 2002-2003; and,
WHEREAS, David R. Matuszczak now desires to pay the due and owing rent and enter into a new lease for said parking lot.
NOW, THEREFORE, BE IT RESOLVED that the Lease Agreement, a copy of which is attached hereto and made a part hereof, wherein the City of West Allis leases on a rental basis to David R. Matuszczak for the sum of One Thousand Dollars ($1,000.00) per year for an one year period and subject to renewal for one year and additional one year periods with increases of Fifty Dollars ($50.00) per year, for nine (9) parking stalls for off-street parking purposes, said portion of an off-street parking lot lying adjacent to Lots 14 and 15 plus the south twenty (20) feet of Lot 12 and the north four (4) feet of Lot 16 in Block 10, Otjen, Pullen & Shenner's Subdivision, being a subdivision located in the Southwest ¼ of Section 34, Township 7 North, Range 21 East, City of West Allis, County of Milwaukee, State of Wisconsin, be and is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Administrative Officer, Clerk/Treasurer be and are hereby authorized and directed to execute the Lease Agreement on behalf of the City upon proof of payment in full of the back-due rent, including the CPI increases as set forth in the September 6, 2000, lease.
