Resolution Relative to the Vacation and Discontinuance of an Alley South of West Lincoln Avenue Between South 78th Street and South 79th Street.

WHEREAS, the public interest requires that an Alley South of West Lincoln Avenue Between South 78th Street and South 79th Street, shown and legally described on the map of the City of West Allis Engineering Department dated September 28th, 1999, File No. Y-1106, which is attached hereto and incorporated herein by reference, be vacated and discontinued; and,
WHEREAS, this Resolution was introduced before the Common Council of the City of West Allis on June 3rd, 2008; Notice of Pendency of the Resolution to vacate the aforesaid alley was filed with the Register of Deeds of Milwaukee County on or about June 3rd, 2008; and Notice of Hearing was published in the official City newspaper on July 10th, 2008, July 17th, 2008 and July 24th, 2008; and,
WHEREAS, no sufficient written objection to the vacation and discontinuance was filed with the City Administrative Officer, Clerk/Treasurer.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis, in accordance with the authority vested in the Common Council by Sec. 66.1003, Wisconsin Statutes, that an Alley South of West Lincoln Avenue Between South 78th Street and South 79th Street, shown and legally described on the map of the City of West Allis Engineering Department dated September 28th, 1999, File No. Y-1106, which is attached hereto and incorporated herein by reference, be and the same is hereby vacated and discontinued, as required by the public interest.
BE IT FURTHER RESOLVED that certain public utility easements for gas, water, storm sewer, sanitary sewer and electric, upon, along, through and under the parcel of property shown and legally described on the map of the City of West Allis Engineering Department dated September 28th, 1999, File No. Y-1106, which is attached hereto and incorporated by reference, and right...
