Resolution Authorizing and Directing the Director of Public Works/City Engineer to Pay For Storm Sewer Lateral Repairs at 9106 West National Avenue in the Total Amount of $4,631.
Body
WHEREAS, the Badger Underground completed emergency repairs to the stormwater lateral at the above address in response to a request from the Engineering Division; and,
WHEREAS, the Engineering Division has determined that the damages occurred were the result of an incomplete design plan which failed to show the proposed storm sewer or lateral for this address and the failure of the WisDOT Project Lighting Contractor to recognize that a storm sewer had been installed at the same location as the light pole; and,
WHEREAS, the Director of Public Works with the assistance of the City Attorney is authorized to review the circumstances and seek reimbursement from all responsible parties, if in the opinion of the City Attorney the City has a valid claim.
NOW, THEREFORE, BE IT RESOLVED By the Common Council of the City of West Allis that the Director of Public Works/City Engineer be and is hereby authorized and directed to make fair payment for the repair work to Badger Underground LLC in the amount of $4,631. Payment to be made from the appropriate Stormwater Sewer Utility account.
