Title
Resolution directing City Departments to study and prepare a report analyzing the differences between City of West Allis ordinances and State law with respect to building, electrical, plumbing, fire, and health regulations.
 
Body
WHEREAS, the City of West Allis has adopted municipal ordinances legislating certain provisions with respect to inspections; and,
 
WHEREAS, State law also exists in many instances that regulates these same inspection areas; and,
 
WHEREAS, in some cases, the City's ordinances may be more restrictive than State regulations; and,
 
WHEREAS, these more restrictive provisions in City ordinances may be a deterrent to development, increasing the tax base, and job creation; and,
 
WHEREAS, it remains important for the City in exercising its inspection regulation authority to continue to maintain the health and safety of business operations and services; and,
 
WHEREAS, there may be certain unique circumstances that justify the City ordinance being more restrictive than State regulation; and,
 
WHEREAS, it is in the best interest of the City to study the differences between the City ordinances and State regulations to determine if the City does have and/or need these more restrictive provisions.
 
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the City Fire, Health, and Building Inspections & Neighborhood Services Departments are hereby directed to prepare a report analyzing the differences between City regulatory ordinances and similar State laws or codes.
 
BE IT FURTHER RESOLVED that said study and report should include a determination of the differences that a department states are necessary and a justification of what the unique circumstances are that makes it so.
 
BE IT FURTHER RESOLVED that said study and report by each Department should be completed and submitted to the Common Council no later than October 31, 2011.
