An Ordinance to Create Section 10.21 of the West Allis Revised Municipal Code Relating to Unregistered Vehicles.

Body

The Common Council of the City of West Allis do ordain as follows:

PART I. Section 10.21 of the Revised Municipal Code is hereby created to read:

10.21 unregistered motor vehicles prohibited on streets.

(1) Definition. In this section, “unregistered motor vehicle” means any motor
vehicle that is located upon any alley, street, highway, public way or thoroughfare and that is not displaying valid registration plates, a temporary operation plate, or other evidence of registration as provided under s. 341.18(1), Wis. Stats., for the vehicle's current registration period or for a registration period for the vehicle that expired within the immediately preceding thirty-one (31) days.

(2) Prohibition. In accordance with Wisconsin State Statutes Section 341.65, no unregistered motor vehicle may be located upon any alley, street, highway, public way or thoroughfare within the city.

(3) Towing. Any vehicle parked on highways in violation of this section which poses a hazard to other vehicles or pedestrians may be towed, pursuant to sec. 349.13(3) of the Wisconsin Statutes.

(4) Penalty. Any person violating sub. (2) of this ordinance shall be required to forfeit not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00). For a second or subsequent violation within a 12-month period, the person shall be required to forfeit not less than two hundred dollars ($200.00) nor more than one thousand dollars ($1000.00). The person shall be required to pay the costs of prosecution. In default of payment thereof, the person shall be imprisoned in the Milwaukee County House of Correction until such forfeiture and costs are paid, but not more than the number of days set forth in sec. 800.095(4) of the Wisconsin Statutes, or by suspension of the defendant's operating privilege, pursuant to Secs. 3...
