Resolution Authorizing the City Attorney to Review the Annual BID Operating Plan and Waiving any Potential Conflict of Interest.
Body
WHEREAS, the City approved creation of the BID on October 18, 1989; and,
WHEREAS, section 66.1109(f) of the Wisconsin Statutes requires that the BID adopt an annual operating plan; and,
WHEREAS, section 66.1109(f)5 requires that the operating plan contain a legal opinion that the terms of the statute have been complied with; and,
WHEREAS, the City Attorney has historically provided this legal review and opinion for the BID as a cost saving measure and the Common Council is of the opinion that such dual representation will not materially limit or adversely affect the City Attorney’s ability to perform his/her representation of the City, and,
WHEREAS, the City wishes to formalize this procedure and provide a waiver for any potential conflict of interest.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of West Allis that the City Attorney is hereby authorized and directed to review the BID Operating Plan, render legal advice to the BID regarding the Operating Plan, and, if the plan meets with the City Attorney’s approval, to approve the Operating Plan.
BE IF FURTHER RESOLVED, that any potential conflict of interest that the City Attorney has in providing this service to the BID is hereby waived and that this service to the BID is contingent upon the BID submitting to the City Attorney an annual resolution of the BID Board waiving any such potential conflict of interest.
