Resolution authorizing the City Engineer to request that the Milwaukee Metropolitan Sewerage District take Jurisdiction over Hale Creek.

WHEREAS, pursuant to the agreement reached at the September 19, 2000, intergovernmental meeting between the staffs of the City of West Allis, the Milwaukee Metropolitan Sewerage District (MMSD) and the Southeastern Wisconsin Regional Planning Commission (SEWRPC), Commission staff has completed a study on Hale Creek; and,
WHEREAS, based on that study, SEWRPC has recommended that Hale Creek be reclassified from an intermittent steam to a perennial stream; and,
WHEREAS, reclassification of Hale Creek to a perennial stream makes Hale Creed a candidate for MMSD jurisdiction under MMSD's advanced planning phase of its ongoing watercourse system plan; and,
WHEREAS, by MMSD taking jurisdiction of Hale Creek, they would be responsible for flood management according to MMSD watercourse policy, for removing any flow impeding debris and would be able to partner more effectively with the Federal and State Governments for any work, such as stream restoration.
NOW, THEREFORE, BE IT RESOLVED By the Common Council of the City of West Allis that the City Engineer be directed and authorized to send a letter to MMSD asking them to take jurisdiction of Hale Creed per SEWRPC's study.
