Resolution relative to determination of Special Use Application for Smokin' Joe's tavern to expand a tavern use within the existing building located at 6139 W. Beloit Rd., formerly Patti's R & R.

Body

WHEREAS, Joseph Jeffords, owner, Smokin' Joe's, duly filed with the City Administrative Officer-Clerk/Treasurer an application for a special use permit, pursuant to Sec. 12.45(2) and Sec. 12.16 of the Revised Municipal Code, to internally expand an existing tavern area within the building located at 6139 W. Beloit Rd., Smokin' Joe's tavern; and,

WHEREAS, after due notice, a public hearing was held by the Common Council on December 21, 2004, at 7:00 p.m., in the Common Council Chambers to consider the application; and,

WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:

1. The applicant, Joseph Jeffords, owner, Smokin' Joe's, resides at 8828 W. Fairmount Ave., Milwaukee, WI 53225.

2. The applicant has a valid offer to purchase the property at 6139 W. Beloit Rd., West Allis, Milwaukee County, Wisconsin, more particularly described as follows:

All the land of the owner being located in the Southeast ΒΌ of Section 3, Township 6 North, Range 21 East, City of West Allis, Milwaukee County, Wisconsin, described as follows:

West 22.50 feet of Lot 2 and East 15.00 feet of Lot 3 in Block 1, being part of Joseph Juneau Subdivision No. 2.

Tax Key No. 475-0328-000

Said land is located at 6139 W. Beloit Rd.

3. The applicant is proposing to internally expand the existing tavern use at 6139 W. Beloit Rd. from approximately 650 sq. ft. to approximately 1,700 sq. ft.

4. The aforesaid premises is zoned M-1 Manufacturing District under the Zoning Ordinance of the City of West Allis, which permits taverns as a special use, pursuant to Sec. 12.45(2) and Sec. 12.16 of the Revised Municipal Code.
