Resolution to Approve a Performance Contract for Energy and Operational Savings with Honeywell, Inc.

WHEREAS, in 1977 the City of West Allis entered into an Agreement with Honeywell, Inc. to implement a performance contract for energy and operational savings; and,

WHEREAS, the performance contract guaranteed that the costs associated with the implementation of those energy savings measures would be totally funded by energy cost reductions in the ten year period of the agreement; and,

WHEREAS, those savings were realized; and,

WHEREAS, in July 2007 the City of West Allis Common Council adopted Resolution R-2007-0163 authorizing the Director of Public Works to enter into a new agreement with Honeywell, Inc. to perform an Energy Efficiency Feasibility Study with funding to pay for the study provided by Focus on Energy Grant Funds; and,

WHEREAS, Honeywell, Inc. conducted an energy audit of all City buildings and in a preliminary report dated November 9, 2007 identified a number of “Energy Conservation Measures” that, if implemented, could, based on energy and/or operational savings over the typical ten year length of a performance contract, pay for themselves; and;

WHEREAS, in a preliminary proposal dated March 18, 2008 Honeywell, Inc. presented City staff with an estimated cost to implement all of the proposed “Energy Conservation Measures”; and,

WEREAS, pursuant to section 66.0133(3) of the Wisconsin Statutes, the City has given notice of its intent to award a second performance contract for energy savings to Honeywell, Inc. and at the same time solicited proposals from other providers of such services; and,

WHEREAS, no other provider of such services submitted a proposal.

NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of West Allis that it herein authorizes the Director of Public Works, with the assistance of the City Attorney, to negotiate the final terms and conditions of a Performance Contract for Compre...
