Resolution relative to the determination of a Special Use Permit for Spoons Ice Cream to be located within the mixed commercial residential use building at 6501-29 W. Greenfield Ave.

WHEREAS, Serenity Medina of Spoons Ice Cream filed with the City Administrative Officer-Clerk/Treasurer an application for a Special Use Permit, pursuant to Sec. 12.42(2) and Sec. 12.16 of the Revised Municipal Code, to establish an ice cream store and restaurant at 6529 W. Greenfield Ave., within a portion of the multi-tenant, mixed-use building at 6501-29 W. Greenfield Ave.; and,
WHEREAS, after due notice, a public hearing was held by the Common Council on March 5, 2013, at 7:00 p.m., in the Common Council Chambers to consider the application; and,
WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:
1. The applicant, Serenity Medina, resides at 2618A W. Forest Home Ave., Milwaukee, WI 53215. The property is owned by Toldt Development, Inc., 4040 N. Calhoun Rd., Brookfield, WI 53005.
2. The applicant, Spoons Ice Cream, will operate primarily as an eat-in and carry-out ice cream store and restaurant, with delivery and catering services available. The store will be located in the western-most commercial space on the first floor of the property located at 6501-29 W. Greenfield Ave., West Allis, Wisconsin, more particularly described as follows:
All the land of the owner being located in the Northeast ΒΌ of Section 3, Township 6 North, Range 21 East, City of West Allis, Milwaukee County, Wisconsin, described as follows:
Parcel 3 of Certified Survey Map No. 7779.
Tax Key No. 454-0639-001
Said land being located at 6501-29 W. Greenfield Ave.
3. The applicant is proposing to establish an ice cream store and restaurant within approximately 1,300-square feet of commercial space, in conjunction with outdoor dining to be located at the front of the property.
