Resolution relative to Determination relative to sale of 0.0465 acres of surplus City-owned property located on the southwest corner of S. 60 St. and W. Greenfield Ave., 60** W. Greenfield Ave. (Tax Key Number 454-0050-003)
Body
WHEREAS, the City of West Allis (the "City") is the owner of certain vacant property vacant property located at the southwest corner of S. 60 St. and W. Greenfield Ave.; and,
WHEREAS, The West Allis Plan Commission, at its meeting of February 28, 2007, recommended approval of the sale of the Property; and,
WHEREAS, a Class II Notice of Public Hearing on the proposed sale has been duly published and a Public Hearing was held before the Common Council on March 20, 2007.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis, pursuant to Chapter 11.15 of the Revised Municipal Code, that the Director of Development is authorized to execute a Purchase and Sale Agreement in the amount of $12,500 for the sale of said real property located at 60** W. Greenfield Ave. (Tax Key No. 454-0050-003) with SIDCOR Real Estate subject to:
1. The approval of a Special Use for a Walgreens within the area of S. 61 St. and W. Greenfield Ave.
2. That the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the Agreement, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transactions contemplated therein.
