Resolution to Approve a Quit Claim Deed Between the City of West Allis and Whitnall-Summit Company, LLC for the Property Located at 67** West Washington Street.

WHEREAS, on November 16th, 2004, by Resolution No. R-2004-0324, the Common Council of the City of West Allis approved an Access Agreement between the City of West Allis ("City") and Whitnall-Summit Company, LLC ("Whitnall-Summit") allowing them to construct a five story 750 stall parking structure on the City-owned 0.253 acre parcel located at 67** West Washington Street, West Allis, WI and legally described as Outlot No. 1 of Certified Survey Map No. 6542, Southeast ΒΌ of Section 34, Township 7 North, Range 21; and,
WHEREAS, Whitnall-Summit also obtained an Access Agreement with A-C Reorganization Trust ("ACRT") for the construction of the parking structure on the 10.653 acre parcel (Utility Corridor) located at 6650 West Washington Street; and,
WHEREAS, on September 20th, 2005, by Resolution No. 2005-0242, the Common Council of the City of West Allis approved the transfer of the City's interest in a 10.653 acre parcel owned by ACRT to Whitnall-Summit for One Dollar ($1.00); and,
WHEREAS, Whitnall-Summit wishes to acquire the parcel at 67** West Washington Street by Quit Claim Deed for One Dollar ($1.00) and other good and valuable consideration; and,
WHEREAS, such transfer of 67** West Washington Street is consistent with prior agreements between the City and Whitnall-Summit; and,
WHEREAS, 67** West Washington Street is surplus land that is not needed by the City.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the Mayor and the City Administrative Officer, Clerk/Treasurer be and are hereby authorized and directed to execute and deliver a Quit Claim Deed from the City of West Allis to Whitnall-Summit Company, LLC for the parcel located at 67** West Washington Street on behalf of the City of West Allis upon the payment of One Dollar ($1...
