Title

Ordinance to amend various sections of the Revised West Allis Municipal Code to permit tanning salons, employment agencies, and photography studios as a permitted use within all commercial districts and to permit physical culture and health services (including swimming pools, gymnasiums, sport/health clubs and health spas) as a special use within all commercial districts.

Body

The Common Council of the City of West Allis do ordain as follows:

PART I. Section 12.41(2)(cc) of the Revised Municipal Code of the City of West Allis is hereby repealed and Section 12.40(1)(pp) and Section 12.41(1)(mm) is hereby created to read:

12.40 C-1 Central Business District

12.41 C-2 Neighborhood Commercial District

(mm) Tanning and toning Salons

PART II. Section 12.41(2)(dd) of the Revised Municipal Code of the City of West Allis is hereby repealed and Section 12.40(1)(k) is hereby repealed and recreated; and Section 12.41(1)(nn) is hereby created to read:

12.40 C-1 Central Business District

(1) Permitted Uses

(k) Employment agencies and offices conditioned upon the following:

(i) Transportation for temporary employees shall not be provided by, or on behalf of, the employment agency from the agency or office to the work site.

(ii) Employees shall not report to the employment agency or office for work assignments. The employees shall report directly to the work site assigned. Applicants for employment shall not be allowed to use public property as a waiting area.

(iii) Restroom facilities adequate for applicants shall be provided on site.
