Resolution authorizing the Director of Development to negotiate the sale of public lands located in the City of West Allis at 9** S. 90 St. (Tax Key No. 442-0131-000) to Kenneth M. Zeman.

Body
WHEREAS, the City of West Allis (the “City”) is the owner of certain real property located at 9** S. 90 St. (Tax Key No. 442-0131-000); and,

WHEREAS, Kenneth M. Zeman, resides at 1001 S. 90th St. at the abutting property; and,

WHEREAS, the City of West Allis's 2030 Comprehensive Plan calls for future land use of the Property to be low density residential; and,

WHEREAS, the City of West Allis currently maintains the property for the maintenance and operation of underground storm sewer and pedestrian access; and,

WHEREAS, the City of West Allis will require that the entire lot will remain an easement for the continued operation and maintenance of storm sewer infrastructure and pedestrian access. No permanent surface structures shall be permitted without the review and consent of the City Engineer; and,

WHEREAS, on July 24, 2013, the Plan Commission determined that the property is surplus public property.

NOW THEREFORE BE IT RESOLVED, that the Common Council of the City of West Allis hereby authorizes the sale of 9** S. 90 St. (Tax Key No. 442-0131-000), to Kenneth M. Zeman.

BE IT FURTHER RESOLVED that the Common Council authorizes the Director of Development or his designee, to sell the property for one ($1) dollar and other good and viable consideration, to negotiate, enter into, execute and deliver into any Agreements or Documents pertaining to the Sale of Land, including, but not limited to an Offer to Purchase, by and between City of West Allis and Kenneth M. Zeman.

BE IT FURTHER RESOLVED that the City Attorney be and is hereby authorized to make substantive changes, modifications, additions and deletions to and from the various provisions of the Agreement, including any and all attachments, exhibits, addendums and amendments, as...
