Resolution Relative to Vacation and Discontinuance of an Alley North of West Orchard Street Between South 91st Street and South 92nd Street.

WHEREAS, the public interest requires that an Alley North of West Orchard Street between South 91st Street and South 92nd Street, shown and legally described on the map of the City of West Allis Engineering Department dated November 22nd, 2004, File No. Y-1147, which is attached hereto and incorporated herein by reference, be discontinued and vacated; and,
WHEREAS, this Resolution was introduced before the Common Council of the City of West Allis on December 7, 2004; Notice of Pendency of the Resolution to vacate the aforesaid alley was filed with the Register of Deeds of Milwaukee County on December 7, 2004; and Notice of Intent was published in the official City newspaper on December 22nd, 2004, December 29th, 2004 and January 5th, 2005; and,
WHEREAS, no sufficient written objection to the vacation and discontinuance was filed with the City Administrative Officer, Clerk/Treasurer.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis, in accordance with the authority vested in the Common Council by Sec. 66.1003, Wisconsin Statutes, that an Alley North of West Orchard Street between South 91st Street and South 92nd Street, shown and legally described on the map of the City of West Allis Engineering Department dated November 22nd, 2004, File No. Y-1147, which is attached hereto and incorporated herein by reference, be and the same is hereby vacated and discontinued, as required by the public interest.
BE IT FURTHER RESOLVED that certain public utility easements for gas, water, storm sewer, sanitary sewer and electric, upon, along, through and under the parcel of property shown and legally described on the map of the City of West Allis Engineering Department dated November 22nd, 2004, File No. Y-1147, which is attached hereto and incorporated by reference, and rights i...
