An Ordinance to Create Subsection 7.05(7)(a) of the West Allis Revised Municipal Code Relating to Refuse Collection and City-Issued Containers.

The Common Council of the City of West Allis do ordain as follows:
PART I. Subsection 7.05(7)(a) of the Revised Municipal Code of the City of West Allis is hereby created to read:
7.05 REFUSE COLLECTION.

(7) Public Nuisance.
(a) City-issued containers. After one written warning, notice, or order per year alleging violations of Section 7.05(3)(a) 1-2, 7.05(4)(a)1, 3, or 7.05(7) are issued to a residential property owner, an order shall be directed to the property owner to purchase a City-issued garbage container(s) within 30 days of service. The order shall state the size of container and number of containers to be purchased, where and when to purchase the container(s), the cost of the container(s), and notice of appeal procedure. Service of the order shall be achieved by mailing it, via first-class mail, to the property owner or by personal service. Where the property owner fails to purchase the required City-issued container(s) within 30 days, the City shall furnish the required containers and assess the cost thereof as a special charge upon the real estate, pursuant to Wis. Stat. § 66.0627(2). Failure to use the City-issued containers in compliance with Section 7.05 may cause the Department to cease refuse collection at said property.

PART II. All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.
PART III. This ordinance shall take effect and be in force from and after its passage and publication.
