Resolution authorizing and directing the City Engineer to submit required notices to the Federal Railroad Administration and other appropriate parties in order to maintain existing railroad quiet zones in the City of West Allis.
Body
WHEREAS, the U.S. Congress enacted the Swift Act in 1994, which directed the Federal Railroad Administration to enact rules requiring the sounding of train horns at all railroad crossings; and,
 
WHEREAS, the proposed rules were issued in January, 2000 and four years later "Interim Final Rules" were issued; and,
 
WHEREAS, the "Interim Final Rules" treat preexisting quiet zones (communities like West Allis who had whistle ban ordinances in effect on both October 9, 1996 and December 18, 2003) differently than new quiet zones; and,
NOW, THEREFORE, BE IT RESOLVED By the Common Council of the City of West Allis that the City Engineer, along with other appropriate City Officials, be and is hereby authorized and directed to submit all required notices to the Federal Railroad Administration and other appropriate parties in order to maintain the existing railroad quiet zones in the City.
