Title

Resolution to Amend and Restate the City's Deferred Compensation Plan with ICMA Retirement Corporation (ICMA-RC).

Body

WHEREAS, the City has established a deferred compensation plan for its employees; and,

WHEREAS, the plan provides two options from which employees may choose to participate; and,

WHEREAS, the City has determined that the continuance of the deferred compensation plan and its administration with ICMA-RC continues to serve these objectives; and,

WHEREAS, amendments to the Internal Revenue Code have been enacted that require changes to the structure of and allow enhancement of the benefits of the deferred compensation plan.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that it hereby amends and restates the ICMA-RC deferred compensation plan (the "Plan") in the form of the 457 Deferred Compensation Plan-Plan and Trust Declaration, copies of which are attached hereto and made a part hereof, and the proper City officers are hereby authorized to execute and deliver the Plan on behalf of the City of West Allis.
