Title

Resolution Authorizing Funding to Conduct an Investigation of Reported Contamination at the Intersection of S. 84th Street and W. National Avenue as Ordered by the Wisconsin Department of Natural Resources in an Amount Not to Exceed $10,000.

 

 

 

Body

 

WHEREAS, the City of West Allis received a letter from the Wisconsin Department of Natural Resources (DNR) notifying the City that soil and potential groundwater contamination had been detected and reported in the middle of the intersection at S. 84th Street and W. National Avenue; and,

 

WHEREAS, based on that information, the DNR, in that letter dated May 29, 2015, has ordered the City to investigate the reported contamination as described under Section 292.11, Wisconsin Statutes, known as the hazardous substances spills law; and,

 

WHEREAS, the DNR ordered the City to hire an environmental consultant by June 28, 2015 which the City has compiled with when the Director of Public Works/City Engineer hired Ayres and Associates for the initial amount of $3,000 to conduct preliminary work; and,

 

WHEREAS, by July 27, 2015, the City must submit a work plan for completing the investigation to the DNR for review and approval; and,

 

WHEREAS, the City must initiate the site investigation with ninety (90) days of submitting the work plan; and,

 

WHEREAS, based on that site investigation the City must submit various other reports and complete any cleanup work that is required as soon as possible.

 

NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City West Allis confirms and authorizes the expenditure of funds to comply with the DNR order.

 

BE IT FURTHER RESOLVED By the Common Council of the City of West Allis that the Director of Public Works/City Engineer is directed and authorized to conduct and supervise all work and to take all appropriate actions in this matter with funding taken from the appropriate account.
