Resolution Authorizing and Directing the Director of Public Works/City Engineer to Sign an Agreement with the Property Owner at 1215 S. 56th Street for Use of Their Property to Install a Retaining Wall and Guard Rail.

WHEREAS, the alley between South 56th Street and South 57th Street and between West Madison Street and West National Avenue has been approved for reconstruction, and

WHEREAS, such project is anticipated to create a disadvantage to the property known as 1215 South 56th Street because the new alley will be above their yard grade at such address, and

WHEREAS, the City is willing to pay for installation of a retaining wall/guard rail to alleviate the grade problem created by the new alley, and

WHEREAS, the property owner is willing to bear the cost of maintaining and repairing the retaining wall/guard rail once constructed by the City.

NOW, THEREFORE, BE IT RESOLVED, that the City of West Allis Engineering Department is hereby directed to install, or arrange for the installation of, a retaining wall and guardrail upon the southerly and westerly portion of the premises known as 1215 South 56th Street. Said retaining wall and guardrail shall become the responsibility of the property owner upon completion of the work. The owner's obligation to maintain and repair the retaining wall/guard rail shall run with the land and the parties agree to record this instrument or to execute such instrument as is necessary to memorialize this agreement in the office of the Milwaukee County Register of Deeds. The City shall pay the cost of recording.

NOW, THEREFORE, BE IT FURTHER RESOLVED By the Common Council of the City of West Allis that the Director of Public Works/City Engineer, along with other appropriate City Officials, be and is hereby authorized and directed to sign the Agreement on behalf of the City of West Allis.
