Title

Resolution Approving the Amended and Restated License Agreement between the City of West Allis and Whitnall Summit Company LLC Relating to the Skywalk Bridge across West Washington Street in the 6600 to 6700 Blocks.

Body

WHEREAS, the City of West Allis and Whitnall Summitt Company LLC entered into a License Agreement - Skywalk Bridge ("Agreement") dated December 10^th, 2004, allowing Whitnall Summitt Company LLC to build a skywalk across West Washington Street; and,

WHEREAS, the certain terms and conditions of said Agreement were incorrect or omitted; and,

WHEREAS, the parties wish to correct those errors.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis as follows:

1.                     That the Amended and Restated License Agreement - Skywalk Bridge is approved in the form attached hereto.

2.                     That the Mayor and the City Administrative Officer, Clerk/Treasurer be and are hereby authorized and directed to execute and deliver the attached Agreement on behalf of the City of West Allis.

3.                     That the City Attorney is hereby authorized to make such non-substantive, technical changes to said Agreement as may be needed to clarify the Agreement or protect the City's interest.
