Resolution relative to approving a lease agreement between Owen W. Klatte and Angie Glocka and the City of West Allis to continue operation of a peony farm on city-owned land located at 119** W. Oklahoma Ave.
Body
WHEREAS, Owen W. Klatte and Angie Glocka had previously operated a peony farm at 119** W. Oklahoma Ave. (Tax Key No. 521-9958-001) via an inherited lease with the City from May 31, 1967 that was terminated in 2013; and,
 
WHEREAS, the continued operation of this peony farm, on an annual basis, provides the City the flexibility to pursue the parcel's highest and best use and allows the operators of the farm the  opportunity to continue to cultivate the peonies and remove them upon proper notice, if needed.
 
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis as follows:
 
1.      That the Director of the Department of Development or his designee, be and is hereby authorized to enter into a lease agreement for the aforesaid terms, which are attached hereto as Exhibit A.
 
2.      That the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the Lease, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transaction contemplated therein.
