Title

 

An Ordinance to Repeal and Recreate Subsection 6.03(7)(e) of the West Allis Revised Municipal Code Relating to the Consumption of Alcohol Beverages at Community Events.

 

Body

 

The Common Council of the City of West Allis do ordain as follows:

 

PART I.                     Subsection 6.03(7)(e) of the Revised Municipal Code of the City of West Allis is hereby repealed and recreated to read:

 

6.03                     PUBLIC WELFARE AND PEACE.

(7)                     Consumption and Possession of Fermented Malt Beverages and Intoxicating Liquors.

(e)                     The Common Council may, by resolution, declare a specific event to be a community event during which event, the prohibitions set forth in this section shall not apply at the location and the date(s) and time specified in the resolution.  The resolution shall identify the designated community event and shall set forth the date or dates, time, and geographic location in which the prohibitions set forth in this section shall not apply.  Any person, business, group, or organization wishing to sell, serve, or give away alcohol beverages must obtain an Extension of Premises permit under Section 9.02(5) or obtain a Temporary Class B (Picnic) License as provides for in Sections 125.26 and 125.51(10) of the Wisconsin Statutes and any other licenses or permits required by law.

 

PART II.                     All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.

 

PART III.                     This ordinance shall take effect and be in force from and after its passage and publication.
