Resolution relative to determination of Special Use Permit for proposed collocation of high speed wireless equipment to be attached to the existing lattice tower located at 2701 S. 92 St.

WHEREAS, Jeff Fowle, d/b/a Clear Wireless, LLC, duly filed with the City Administrative Officer, Clerk/Treasurer an application for a Special Use Permit, pursuant to Sec. 12.16, 12.23 and 12.41(2) of the Revised Municipal Code to place three (3) panel antennas and three (3) directional (dish) antennas at the 130-foot level and to construct an equipment cabinet on the southeast corner of the fenced compound at 2701 S. 92 St.; and,

WHEREAS, after due notice, a public hearing was held by the Common Council on March 2, 2010, at 7:00 p.m. in the Common Council Chamber to consider the application; and,

WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:

1. The applicant, Jeff Fowle, d/b/a Clear Wireless, LLC has principal offices at 1630 Deer Trail, Waukesha, WI 53189.

2. The property more particularly described as follows:

All the land of the owner being located in the Southeast ¼ of Section 8, Township 6 North, Range 21 East, in the City of West Allis, Milwaukee County, State of Wisconsin, described as follows:

Commencing at the Northeast corner of said Southeast ¼ ; thence Southerly, 53.37 feet along ¼ section line; thence Westerly, 55.00 feet to the Point of Beginning; thence Southerly, 143.00 feet, along West right-of-way line of South 92nd Street; thence Westerly, 130.00 feet; thence Northerly, 144.75 feet to the South right-of-way line of West Cleveland Avenue; thence Southeasterly, 33.50 feet, along said South line; thence Easterly, 96.50 feet, along said South line to the Point of Beginning.
