An Ordinance to Create Subsection 2.19(9) of the West Allis Revised Municipal Code Relating to Fees for Warrants (Sponsored by Ald. Czaplewski).

The Common Council of the City of West Allis do ordain as follows:

 

PART I.                     Subsection 2.19(9) of the Revised Municipal Code is hereby created to read:

 

2.19                     MUNICIPAL JUDGE.

(9)                     Warrants.                     

 

(a)                     Warrant processing fee.  A warrant processing fee of twenty-five dollars ($25.00) shall be imposed for each warrant issued by the Municipal Judge.

 

(b)                     Warrant pick-up fee.  Whenever a person who is wanted on a non-West Allis warrant, commitment, or other judicial order commanding a law enforcement officer to seize and hold the person is taken into custody by a West Allis police officer, a warrant pick-up fee of twenty-five dollars ($25.00) shall be assessed to the person picked up on such warrant.  Said fee shall be added to the bond amount of the warrant.

 

(c)                     Petition to Municipal Judge.  A person for whom a West Allis warrant has been issued or who has been taken into custody by a West Allis police officer on a non-West Allis warrant may petition the Municipal Judge for relief from the fees imposed in this section.  The judge may, in his/her discretion, waive the fee where the fee imposes a hardship or where it is in the interest of justice.

                                                                                    

PART II.                     All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.

 

PART III.                     This ordinance shall take effect and be in force from and after its passage and publication.
