Resolution Authorizing and Directing the Director of Public Works/City Engineer to Sign a Lease Termination Agreement and General Release with Nextel West Corp. for Removal of Nextel's Communication Equipment on the 116th Water Tower.
Body
WHEREAS, the City of West Allis and Nextel entered into a Water Tower Lease Agreement dated October 1, 2003 for installation of equipment related to their communication facility on the 116th Street water tower and surrounding property; and,
WHEREAS, Nextel wishes to terminate that agreement per the terms of the Lease Agreement; and,
WHEREAS, the City Attorney has reviewed and approves the Lease Termination Agreement as modified; and,
NOW, THEREFORE, BE IT RESOLVED By the Common Council of the City of West Allis that the Director of Public Works, and/or other appropriate City Officials, be and is hereby authorized and directed to sign the Lease Termination Agreement with Nextel on behalf of the City of West Allis
NOW, THEREFORE, FUTHER BE IT RESOLVED that the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the Lease Termination Agreement, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, including but not limited to, any and all changes necessary to preserve the intent of the Common Council of the City of West Allis.
