An Ordinance to repeal and recreate Section 2.02 of the City of West Allis Revised Municipal Code relative to Appointees, Officials, and Employees and repeal and recreate Section 2.09(2) of the City of West Allis Revised Municipal Code relative to Powers and Duties of the Mayor.

Body
The Common Council of the City of West Allis do ordain as follows:

PART I. Section 2.02 of the City of West Allis Revised Municipal Code shall be repealed and recreated as follows:

“2.02 APPOINTIVE OFFICIALS AND EMPLOYEES.

(1) Unclassified Service. All non-elective officials in the Executive Service (Department Heads) shall be appointed by the Mayor, in writing, subject to confirmation by the Common Council, unless otherwise provided. Said appointment by the Mayor and confirmation by the Common Council shall be in accordance with the official policy adopted by the Common Council by resolution and incorporated into the City Policies & Procedures Manual. All other employees in the unclassified service shall be appointed by the Department Head. The compensation, benefits, and terms and conditions of employment of appointive officials and employees shall be governed by the applicable provisions of the Ordinances of the City, the Revised Municipal Code and future amendments thereto, and the terms and conditions of the employment contracts, where applicable. An appointee by the Mayor requiring confirmation by the Common Council who is rejected by the Common Council shall be ineligible for appointment to the same office for one year thereafter.

Non-elective officials and employees in the unclassified service shall hold their offices/positions for terms established by their appointing power, subject to removal as provided by procedures adopted by the Common Council in City Policies, or as otherwise provided in section 2.76 of this Chapter, by any applicable employment contracts or by State law.
