Resolution relative to determination of Special Use Permit for Fusion Café, a proposed restaurant to be located within the multi-tenant building at 1427 S. 108 St.

WHEREAS, Rong Shi, d/b/a SL 100, LLC duly filed with the City Administrative Officer-Clerk/Treasurer an application for a Special Use Permit, pursuant to Sec. 12.42(2) and Sec. 12.16 of the Revised Municipal Code, to establish Fusion Café, a restaurant with outdoor dining at 1427 S. 108 St.; and,

WHEREAS, after due notice, a public hearing was held by the Common Council on June 19, 2012, at 7:00 p.m., in the Common Council Chambers to consider the application; and,

WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:

1. The applicant, Rong Shi, d/b/a SL 100, has offices at 1198 George Towne Dr., Pewaukee, WI 53072.

2. The applicant will occupy approximately 2,360 sq. ft. of the 4,000 sq. ft. two-tenant building at 1427 S. 108 St., West Allis, Milwaukee County, Wisconsin, more particularly described as follows:

All the land of the owner being located in the Northeast ¼ of Section 6, Township 6 North, Range 21 East, City of West Allis, Milwaukee County, State of Wisconsin, describes as follows:

Beginning at the Northeast corner of Parcel 1, Certified Survey Map No. 3800; thence Northwesterly, 100.30 feet, along the West right-of-way line of South 108th Street; thence Westerly, 213.21 feet; thence Southerly, 100.00 feet; thence Easterly, 221.30 feet to the West right-of-way line of South 108th Street and Point of Beginning.

Said land located at: 1427 S. 108 St.

3. The applicant is proposing to occupy an approximate 2,360 square foot portion of the two-tenant building for Fusion Café which will also utilize outdoor dining on the site.
