A Resolution to Amend the Noise/Vibration Variance Issued to Motor Castings Company.

WHEREAS, Motor Casting Company has a Variance issued by the West Allis Health Department pursuant to section 7.035 of the Revised Municipal Code; and,
WHEREAS, Motor Casting Company has requested an amendment to said Variance to eliminate the requirement of a sound barrier; and,
WHEREAS, Motor Casting Company is instead proposing that it cease using pulsers between the hours of 10:00 p.m. and 7:00 a.m. daily; and,
WHEREAS, the Variance expires after January 31, 2015, and the expense of the sound barrier for the remainder of the Variance term is unreasonable; and,
WHEREAS, the License & Health Committee has held hearings regarding the proposed amendment to the Variance and have made Findings of Fact, Conclusions of Law, and a Recommendation to the Common Council.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the Findings of Fact and Conclusions of Law of the License & Health Committee are hereby adopted.
BE IT FURTHER RESOLVED that the work plan for the Noise Variance issued to Motor Castings Company is hereby amended to eliminate the sound barrier requirement and to instead prohibit Motor Castings Company from operating pulsers between the hours of 10:00 p.m. and 7:00 a.m. daily.
