Resolution to approve an amendment to the agreement for disposal of solid waste by and between Superior of Wisconsin, Inc. and the City of West Allis

WHEREAS, the City of West Allis (“City”) has entered into an Agreement with Superior of Wisconsin, Inc. of Muskego, Wisconsin (formerly Browning-Ferris Industries, Town & County Waste Service of Muskego, Wisconsin)(“Contractor”) for the disposal of solid waste, said Agreement dated May 11, 1984, as amended by Amendments dated April 23, 1987, April 1, 1993, April 14, 1997, June 19, 2001, and September 3, 2003 (the “Agreement”); and,
WHEREAS, the Agreement will expire at 11:59 p.m. on December 31, 2007; and,
WHEREAS, the parties desire to modify certain terms and conditions (the “Amendment”); and,
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the Amendment to the Agreement, a copy of which is attached hereto and made a part hereof, be and is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk/Treasurer be and are hereby authorized and directed to execute and deliver the Amendment of behalf of the City of West Allis.
