Resolution authorizing the Director of Public Works/City Engineer to enter into an agreement  for reimbursement for private property inflow and infiltration removal under private contracts with MMSD in an amount not to exceed $50,000.

Body

WHEREAS, Wisconsin law, through Section 66.0301 Stats., authorizes any municipality to enter into an intergovernmental cooperation agreement with another municipality for the furnishing of services; and

 

WHEREAS, during wet weather events stormwater enters private lateral sewers through defective pipes and leaky joints and connections (“infiltration) and stormwater also enters private lateral sewers from foundation drains, improper connections and other sources (“inflow”); infiltration and inflow increases the amount of wastewater that the District must collect and treat; and

 

WHEREAS, MMSD has made available to its communities a source of funding to reduce infiltration and inflow from private property, and

 

WHEREAS, the West Allis Engineering Department has proposed to MMSD a work plan that includes the installation of sump pumps and sanitary lateral lining as the best way to use the City's share of MMSD funding.

 

NOW, THEREFORE, BE IT RESOLVED, that the Director of Public Works/City Engineer is hereby authorized and directed to sign the funding agreement titled Private Property Infiltration and Inflow Reduction Agreement with MMSD.

 

NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the Agreement, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof.
