An Ordinance to amend Subsection 10.035 and 10.11(1)(a) of the West Allis Revised Municipal Code Relating to the Authority of the Director of Public Works and Snow Emergency Regulations.

The Common Council of the City of West Allis do ordain as follows:

PART I. Section 10.035 of the Revised Municipal Code of the City of West Allis is hereby amended to read:

10.035 AUTHORITY OF DIRECTOR OF PUBLIC WORKS.

The Director of Public Works and those employees designated by the director may enforce the snow emergency regulations set forth in Section 10.11, in addition to Police Officers. The Director and designated employees shall have the authority to issue parking citations and have a vehicle in violation of Section 10.11 towed, pursuant to section 9.24(b). A Police Officer shall also have the authority to issue a parking citation and have a vehicle towed that is parked in violation of Section 10.11 when the vehicle inhibits the efficient removal of snow from a street during a snow plowing operation.

PART II. Section 10.11(1)(a) of the Revised Municipal Code of the City of West Allis is hereby amended to read:

10.11 SNOW EMERGENCY REGULATIONS.

(1) Declaration of Emergency.

(a) When, in the opinion of the Director of Public Works, a snowstorm jeopardizes the public safety and welfare of the City, the Director may declare a state of public emergency for the duration thereof. This declaration shall be made through the medium of radio, television or other means of public communication. Such declaration shall specify a time, at least one (1) hour after its promulgation, when the emergency will take effect. Such declaration shall coincide as reasonably practicable to the all-night parking regulations, Section 10.10.5.

PART III. All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.
