A Resolution to Amend the City’s Policies & Procedures Manual No. 2806 Relating to Special Assessments & Sidewalk Improvements.

WHEREAS, Policy No. 2806 sets forth rules and procedures for special assessments and sidewalk improvements; and,
WHEREAS, current policy requires the Engineering Department to make sidewalk improvements and repair when certain criteria for defects are present; and
WHEREAS, the policy sets forth duties that are not required by statute or law, may not be appropriate in every circumstance, and is adequately addressed by another policy; and
WHEREAS, the change in policy to make the sidewalk improvement duties discretionary will not have an adverse impact upon the City and will lessen the City’s liability for claims concerning sidewalk improvements and repair; and
WHEREAS, removing the mandatory requirements of this policy will allow the training and experience and knowledge of the Engineering Department and Department of Public Works to better address sidewalk improvements and repair within the budgetary constraints that the City faces.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the amendments to Policy No. 2806 as attached hereto are hereby approved and adopted.
