Resolution Relative to the Vacation and Discontinuance of a Public Alley off of South 82nd Street and North of West Orchard Street.
Body
WHEREAS, the public interest requires that a Public Alley off of South 82nd Street and North of West Orchard Street, shown and legally described on the map of the City of West Allis Engineering Department dated May 16th, 2011, File No. Y-1176, which is attached hereto and incorporated herein by reference, be vacated and discontinued; and,

WHEREAS, this Resolution was introduced before the Common Council of the City of West Allis on June 7th, 2011; Notice of Pendency of the Resolution to vacate the aforesaid public alley was filed with the Register of Deeds of Milwaukee County on or about June 7th, 2011; and Notice of Hearing was published in the official City newspaper on July 7th, 2011, July 14th, 2011, and July 21st, 2011; and,

WHEREAS, no sufficient written objection to the vacation and discontinuance was filed with the City Administrative Officer, Clerk/Treasurer.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis, in accordance with the authority vested in the Common Council by Sec. 66.1003, Wisconsin Statutes, that a Public Alley off of South 82nd Street and North of West Orchard Street, shown and legally described on the map of the City of West Allis Engineering Department dated May 16th, 2011, File No. Y-1176, which is attached hereto and incorporated herein by reference, be and the same is hereby vacated and discontinued, as required by the public interest.

BE IT FURTHER RESOLVED that certain public utility easements for gas, water, storm sewer, sanitary sewer and electric, upon, along, through and under the parcel of property shown and legally described on the map of the City of West Allis Engineering Department dated May 16th, 2011, File No. Y-1176, which is attached hereto and incorporated by reference, and rights incidental thereto, and all rights of entrance, mainte...
