Title

Resolution requesting a waiver from requirements for a sidewalk or pedestrian accommodations on the proposed S. 100th Street reconstruction project due to a lack of support from residents adjacent to project.

 

Body

WHEREAS, The Wisconsin State Legislature recently adopted a change to Wisconsin State Statutes 84.01(35)(d)(2) so that the Wisconsin Department of Transportation may not establish a bikeway or pedestrian way as a part of a new highway construction or reconstruction project unless the governing body of the municipality in which a portion of the project will occur has adopted a resolution authorizing the Department to establish the bikeway or pedestrian way, and

 

WHEREAS, The City of West Allis conducted a survey of the residents on S. 100th Street from 647 S. 100th Street to 829 S. 100th Street to ascertain their level of support and found that 92% of the residents who responded to the survey opposed the construction of a new sidewalk, and

 

WHEREAS, The City of West Allis Common Council also previously passed resolutions R-2013-0154 and R-2013-0155 on July 1, 2013 requesting a waiver from requirements for Bicycle Accommodations on S. 100th Street due to an absence of need and a constrained environment, and

 

WHEREAS, The City of West Allis has entered into an agreement with the Wisconsin Department of Transportation to replace S. 100th Street from a point 490 feet south of W. Schlinger Avenue to the Hank Aaron State Trail as part of the Zoo Interchange reconstruction in the City of West Allis (WisDOT Project No. 1060-33-80/81).

 

NOW THEREFORE BE IT RESOLVED by the West Allis Common Council that the Director of Public Works/City Engineer shall request a waiver from requirements for a sidewalk or pedestrian accommodations on the proposed S. 100th Street reconstruction, as part of the Zoo Interchange reconstruction (WisDOT Project No. 1060-33-80/81) in accordance with the newly adopted Wisconsin State Statutes 84.01(35)(d)(2).
