Resolution Relative to Relinquishing a Storm Sewer Easement on the Property Located at 8717 West Lincoln Avenue (Tax Key No. 487-0014-000).

WHEREAS, on May 19th, 1953, the Common Council of the City of West Allis adopted Resolution No. 5036, which accepted a permanent easement for the installation and maintenance of a storm sewer in, under and across the property in the City of West Allis, County of Milwaukee, State of Wisconsin, described as thru the east seven (7) feet of the East forty-one (41) feet of the north One Hundred Twenty (120) feet of the south 266.75 feet of Lot One (1), Block Two (2), Assessor's Plat No. 262, in the Northwest One-quarter (NW¼) of Section Nine (9), town Six (6) North, Range Twenty-one (21) East, in the City of West Allis, Milwaukee County, Wisconsin, which was recorded in the office of the Register of Deeds for Milwaukee County on July 13th, 1953, in Volume No. 3178, Page No. 267, as Document No. 3218270; and,
WHEREAS, the owners gave, granted, conveyed and released unto the City of West Allis, and to its successors and assigns forever, the right to enter upon the hereinafter described real estate to construct, repair, and maintain an underground storm sewer on the land described as thru the east seven (7) feet of the East forty-one (41) feet of the north One Hundred Twenty (120) feet of the south 266.75 feet of Lot One (1), Block Two (2), Assessor's Plat No. 262, in the Northwest One-quarter (NW¼) of Section Nine (9), town Six (6) North, Range Twenty-one (21) East, in the City of West Allis, Milwaukee County, Wisconsin; and,
WHEREAS, the aforesaid storm sewer easement is no longer necessary for any public purpose.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the City of West Allis, having no further interest in the aforesaid storm sewer easement, does hereby release and relinquish all rights and interests of whatever nature in said land and abandons the aforesaid storm...
