Resolution Relative to Discontinuance and Vacation of a 386' long x 18' wide Portion of the City Right-of-Way Along the South Side of West National Avenue Between South 78th Street and South 80th Street.

WHEREAS, the public interest requires that a 386' long x 18' wide portion of the City Right-of-Way along the South side of West National Avenue between South 78th Street and South 80th Street, shown and legally described on the map of the City of West Allis Engineering Department dated June 15th, 2007, File No. Y-1158, which is attached hereto and incorporated herein by reference, be discontinued and vacated; and,
WHEREAS, this Resolution was introduced before the Common Council of the City of West Allis on June 19th, 2007; Notice of Pendency of the Resolution to vacate the aforesaid City Right-of-Way was filed with the Register of Deeds of Milwaukee County on June 20th, 2007; and Notice of Hearing was published in the official City newspaper on July 12th, 2007, July 19th, 2007 and July 26th, 2007; and,
WHEREAS, no sufficient written objection to the discontinuance and vacation was filed with the City Administrative Officer, Clerk/Treasurer.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis, in accordance with the authority vested in the Common Council by Sec. 66.1003, Wisconsin Statutes, that a 386' long x 18' wide portion of the City Right-of-Way along the South side of West National Avenue between South 78th Street and South 80th Street, shown and legally described on the map of the City of West Allis Engineering Department dated June 15th, 2007, File No. Y-1158, which is attached hereto and incorporated herein by reference, be and the same is hereby discontinued and vacated, as required by the public interest.
