Resolution relative to determination of Special Use Permit for Foster-Holley Funeral Home, a proposed funeral home, to be located at 8802 W. Becher St.

WHEREAS, Mike Herl, d/b/a Paulie K, LLC, duly filed with the City Clerk an application for a Special Use Permit, pursuant to Sec. 12.16 and Sec. 12.41(2) of the Revised Municipal Code of the City of West Allis, to establish a funeral home at 8802 W. Becher St.; and,

WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:

1. Mike Herl, d/b/a Paulie K, LLC, owns the property at 8802 W. Becher St. and has offices at 605 Orddossagon Way, Madison, WI 53719.

2. The applicant is proposing to lease the property to the Foster-Holley Funeral Home. The funeral service tenant is Foster-Holley (Bryan Foster and Marion Holley). The subject property is located at 8802 W. Becher St., West Allis, Milwaukee County, Wisconsin, more particularly described as follows, to-wit:

All the land of the owner being located in the Southwest 1/4 of Section 4, Township 6 North, Range 21 East, in the City of West Allis, Milwaukee County, State of Wisconsin, described as follows:

Lots 3, 4 and 5 in Block 5 of the Assessors Plat No. 254.

Tax Key No. 478-0072-001

Said land being located at 8802 W. Becher St.

3. The building is about 4,000 square feet and will be occupied by the funeral home tenant. A crematory service will not be provided. The aforesaid premise is zoned C-2/Neighborhood Commercial District under the Zoning Ordinance of the City of West Allis, which permits funeral homes as a special use, pursuant to Sec. 12.16 and Sec. 12.41(2) of the Revised Municipal Code.

4. The applicant has indicated that they are trying to work out an arrangement with the abutting property owner to the west. This lot is currently unimproved gravel/dirt lot, but if improved (paved and drained) would support an additional 15-2...
