Title
An Ordinance to amend Subsection 2.38(3) and Subsection 12.13(12) of the West Allis Revised Municipal Code relating to appeals of Plan Commission decisions being considered by the Common Council and to amend Subsection 2.39(2) relative to the function and duties of the Board of Appeals.

The Common Council of the City of West Allis do ordain as follows:
PART I. Subsection 2.38(3)(g) of the Revised Municipal Code of the City of West Allis is hereby amended to read as follows:
2.38 Plan Commission.

(3) Organization and Procedure

(g) All Plan Commission decisions shall be appealed to the Common Council.
PART II. Subsection 12.13(12) of the Revised Municipal Code of the City of West Allis is hereby amended to read as follows:
12.13 Site, Landscaping and Architectural Review Procedures

(12) Appeals. Any person aggrieved by a decision of the Plan Commission under this Section may appeal that decision to the Common Council.
PART III. Subsection 2.39(2) of the Revised Municipal Code of the City of West Allis is hereby amended to read as follows:
2.39 Board Of Appeals.

(2) Functions and Duties. The Board shall have such functions and duties as are prescribed by
Section 12.15 of this Code and Sec. 62.23(7)(e) of the Wisconsin Statutes.
PART IV. All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.
PART V. This ordinance shall take effect and be in force from and after its passage and publication.
