Resolution relative to determination of Special Use Permit for Rockstar Tattoo & Co., a proposed tattoo, piercing and jewelry, and clothing sales operation to be located at 2707 S. 108 St., within the Shoppes on 100 retail center. (Tax Key No. 520-0003-000)

Body
WHEREAS, Brock Baumgartner, d/b/a/ Rockstar Tattoo & Co., LLC duly filed with the City Administrative Officer-Clerk/Treasurer an application for a special use permit, pursuant to Sec. 12.43(2) and Sec. 12.16 of the Revised Municipal Code, for the proposed establishment of a tattoo, body piercing and retail business to be located at 2707 S. 108 St. within the Plaza 100 shopping center; and,

WHEREAS, after due notice, a public hearing was held by the Common Council on May 5, 2009, at 7:00 p.m., in the Common Council Chamber to consider the application; and,

WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:

1. The applicant, Brock Baumgartner, d/b/a/ Rockstar Tattoo & Co., LLC, resides at 220 S. 18 Ave., Apt. 4, West Bend, WI 53095.

2. The applicant has a valid offer to lease the property at 2707 S. 108 St., West Allis, Milwaukee County, Wisconsin, more particularly described as follows:

All the land of the owner being located in the Southeast ΒΌ of Section 7, Township 6 North, Range 21 East, City of West Allis, Milwaukee County, Wisconsin, described as follows:

Lots 3 thru 9 including adjacent vacated street right-of-way adjacent to these lots, in the Block 1 of the National Avenue Homesites Subdivision.

Tax Key No. 520-0003-000.

Said land being located at 2707 S. 108 St.

3. The applicant is proposing to establish a tattoo, body piercing and retail business within a multi-tenant retail building (Plaza 100) and will offer the following services: tattooing, body piercing, and retail sales.
