Resolution relative to determination of Special Use Permit for Chick-fil-A, Inc., a proposed restaurant with drive-thru facilities, to be located at 2677 S. 108 St.
Body
WHEREAS, Jason Hill, d/b/a Chick-fil-A, Inc. duly filed with the City Clerk an application for a special use permit, pursuant to Sec. 12.43(2) and Sec. 12.16 of the Revised Municipal Code, to establish a Chick-fil-A Restaurant with drive-thru and outdoor dining on a portion of the existing property with an address of 2677 S. 108 St. and a portion on the property with an address of 2563-2601-25-65-73-75 S. 108 St.; and,
WHEREAS, after due notice, a public hearing was held by the Common Council on February 2, 2011, at 7:00 p.m., in the Common Council Chambers to consider the application; and,
WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:
1. The applicant, Jason Hill, d/b/a Chick-fil-A, Inc. has offices at 5200 Buffington Rd., Atlanta, GA 30349.
2. The applicant will be creating an outlot and leasing it on a portion of 2677 S. 108 St. and a portion on the property with an address of 2563-2601-25-65-73-75 S. 108 St., West Allis, Milwaukee County, Wisconsin, more particularly described as follows:
All the land of the owner located in the Northeast 1/4 of Section 7, Township 6 North, Range 21 East, City of West Allis, Milwaukee County, Wisconsin, described as follows:
Commencing at the Southwest corner of Parcel 2, Certified Survey Map No. 4282; thence North 12?45'54" East, 196.59 feet; thence North 00?45'21" West, 43.00 feet to the Point of Beginning; thence continue North 00?45'21" West, 167.00 feet; thence North 89?41'11" East, 197.49 feet; thence South 56?44'49" East, 18.09 feet, to the West right-of-way line of South 108th Street; thence South 00?45'21" East, 157.00 feet, along said right-of-way line; thence South 89?41'11" West, 212.50 feet , to the Point of Beginning.
