An Ordinance to Amend Section 9.11(4)(e) of the Revised Municipal Code Relating to the Elimination of Taxicab and Taxicab Operator's Licenses.

Findings

WHEREAS, Wisconsin Statutes Section 349.24(1) states in part that "The council of any city and every village or town board may:" regulate taxicabs and operators of taxicabs; and,

WHEREAS, it is determined that Wisconsin Statutes Section 349.24(1), does not require the City to license or regulate taxicabs and operators of taxicabs; and,

WHEREAS, the cost to the City associated with such regulation has become increasingly expensive; and,

WHEREAS, it is found that no other municipality within the County of Milwaukee, save for the City of Milwaukee, currently actively engages in the regulation of taxicabs and operators of taxicabs; and,

WHEREAS, it is found that the regulation of taxicabs and operators of taxicabs is best left to the City of Milwaukee, for uniformity of regulation and ease of administration.

NOW, THEREFORE, it is determined that it is in the best interest of the City to phase out any involvement in the regulation of taxicabs and taxicab operators, such that it shall become an unregulated activity within the City and the Common Council of the City of West Allis do ordain as follows:

PART I. Section 9.11(4)(e) of the Revised Municipal Code of the City of West Allis is hereby amended to read:

9.11 TAXICABS.

(4) Licenses Required.

(e) Elimination of Licenses.

1. Subsection 9.11(4)(c) notwithstanding, no new licenses for taxicab operators or taxicabs shall be granted by the City. Such licenses which are in existence as of the date of adoption of this ordinance may continue to be renewed, except as set forth in Subsection 2. Any license that is not renewed shall not be issued to any other operator or taxicab and the respective quotas shall be accordingly reduced until there are no licensed taxicabs and taxicab operators in the City o...
