Resolution Authorizing the Acceptance of Dedication of Lands and Interests at 1710 S. 108 St. for Municipal Access Easement.
Body
WHEREAS, the owner of certain lands and interests as described on Exhibit "A", which is attached hereto and made a part hereof, wishes to build a commercial development; and,
WHEREAS, said commercial development will impact traffic flow in the area and in particular on State Trunk Highway 100; and,
WHEREAS, future development will require ingress and egress other than on to State Trunk Highway 100 at West Mitchell Street; and,
WHEREAS, the owner of the lands has offered to dedicate an easement across said lands for ingress and egress purposes; and,
WHEREAS, there will be no displacement of persons or property as a result of the dedication.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the City Attorney be and is hereby authorized and directed to acquire by dedication the lands and interests set forth in Exhibit "A" from the record owners thereof and from any and all other persons or entities who may have an interest in said lands.
BE IT FURTHER RESOLVED that the Mayor and other City Officials are authorized to accept said dedication of lands and interests.
BE IT FURTHER RESOLVED that the City of West Allis hereby declares its intent not to proceed with acquisition of the aforesaid lands and interests under the eminent domain procedures of Chapter 32 of the Wisconsin Statutes.
