Title
Resolution to transfer ownership, by Quit Claim Deed, of a property owned by Toldt Development Inc. located at 66** W. National Ave. and 66** W. Mitchell St. (Tax Key No. 454-0643-000 and 454-0644-000), to the City of West Allis.

Body
WHEREAS, the City of West Allis recipient of a U.S. Environmental Protection Agency Grant in the amount of $200,000 must own the property in order to complete environmental cleanup and remediation on the site; and

WHEREAS, the City will clean up the site via the grant fund, in order to set the stage for development; and

WHEREAS, the City wishes to receive the Property by Quit Claim Deed from Toldt Development, Inc. for One Dollar ($1.00) and other good and valuable consideration; and,

WHEREAS, upon completion of the cleanup and remediation activities to the City's satisfaction, Toldt Development Inc. will purchase the property back from the City via Quit Claim Deed for One Dollar ($1.00) and other good and valuable consideration.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis as follows:

1. That the Common Council of the City of West Allis hereby receives ownership of the properties at 66** W. National Ave and 66** W. Mitchell St. by Quit Claim Deed from Toldt Development Inc., and upon completion of the cleanup and remediation activities to the City's satisfaction, Toldt Development Inc. will purchase the property back from the City via Quit Claim Deed for One Dollar ($1.00) and other good and valuable consideration.

2. That the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the Quit Claim Deed, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepar...
