Resolution Authorizing Acquisition and/or Permanent Limited Easement for Certain Lands and Interests Located in the City of West Allis, WI, for Improving the Turning Radius of the North/South and East/West "T" Alley Between S. 77 St. and S. 78 St., 120 Feet North of W. National Ave.
Body

WHEREAS, the City of West Allis desires to acquire certain lands and interest for fee or Permanent Limited Easement for public purposes, as shown and described on Engineering Drawing File No. Y-1146, dated August 4th, 2005, which is attached hereto as Exhibit "A" and made a part hereof (the "Project"); and,

WHEREAS, there will not be persons displaced as a result of the lands and interests required.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis as follows:

1. That the City Engineer be and is hereby authorized and directed to negotiate the acquisition of the lands and interests required for the Project, as shown on the Engineering Drawing File No. Y-1146, and to make such payments for expenses incidental to the transfer of the lands and interests, as may be required, pursuant to Section 32.195 of the Wisconsin Statutes, and guidelines promulgated thereunder by the Wisconsin Department of Commerce.

2. That in the event the aforesaid lands and interests cannot be obtained by negotiation, the City Attorney be and is hereby authorized and directed to acquire by condemnation, pursuant to Chapter 32 of the Wisconsin Statutes.

3. That the Mayor and City Administrative Officer, Clerk/Treasurer are hereby authorized and directed to sign such documents, as may be necessary in connection with the aforesaid acquisition.

4. That the Parcel Cost Estimate, which is attached hereto as Exhibit "B" and made a part hereof, is hereby approved as just compensation for the lands and interests to be acquired.

5. That the City Comptroller be and is hereby authorized and directed to disburse the necessary moneys for the aforesaid acquisit...
