Resolution directing the Director of Development to submit and execute an Offer to Purchase for the property located at 11300 W. Cleveland Ave.

WHEREAS, the Wisconsin Department of Natural Resources and the City of West Allis wish to promote flood control;

WHEREAS, the Common Council of the City of West Allis (the “City”), under Resolution No. R-2012-0067 dated 3-06-12, authorized the Director of Development to submit an application to the State of Wisconsin for financial aid for Municipal Flood Control Grant protection purposes, sign documents and take necessary actions to undertake, direct and complete and approved flood control project;

WHEREAS the City of West Allis received approval of a 2012 Municipal Flood Control Grant from the Wisconsin Department of Natural Resources totaling $108,080;

WHEREAS, the total purchase price of 11300 W. Cleveland Ave. is estimated at $105,000, which is to be funded 70% by a Wisconsin Department of Natural Resources Municipal Flood Control Grant and 30% matching Storm Water Utility funds;

WHEREAS the Director of Development is duly authorized and directed to proceed to negotiate the acquisition of the Property; and,

WHEREAS the City Attorney will review all terms and conditions of the Offer to Purchase.

NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis, the Director of Development is directed to execute an Offer to Purchase for the property located at 11300 W. Cleveland Ave.

BE IT FURTHER RESOLVED that the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the Agreement, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other ...
