An Ordinance to Amend Subsection 9.15(3)(a)1, Repeal and Recreate 9.15(4), and Repeal Subsection 9.15(5) of the West Allis Revised Municipal Code Relating to Pawnbroker License Fee, and License Issuance and Granting.
Body
The Common Council of the City of West Allis do ordain as follows:

PART I. Subsection 9.15(3)(a)1 of the Revised Municipal Code of the City of West Allis is hereby amended to read:

9.15 PAWN SHOPS, SECONDHAND STORES, JUNK SHOPS, PRECIOUS METAL AND GEM DEALERS.

(3) Licenses.

(a) Fees.

1.The License fee for a pawnbroker's license shall be Two Hundred Ten dollars ($210.00) per year.

PART II. Subsection 9.15(4) of the Revised Municipal Code of the City of West Allis is hereby repealed and recreated to read:

9.15 PAWN SHOPS, SECONDHAND STORES, JUNK SHOPS, PRECIOUS METAL AND GEM DEALERS.

(4) License Issuance and Granting.

(a) Application for Licenses shall be submitted to the City Clerk who shall refer each application to the Common Council. Required license fees shall accompany any application received by the Clerk.

(b) The Common Council may grant the license if the following apply:

(1) The applicant, including an individual, a partner, a member of a limited liability company or an officer, director or agent of any corporate applicant, has not be convicted within the proceeding ten (10) years of a felony or within the proceeding five (5) years of a misdemeanor, statutory violations punishable by forfeiture or county or municipal ordinance violation in which the circumstances of the felony, misdemeanor or other offense substantially relate to the circumstances of being a pawn broker, secondhand or junk dealer, or precious metal and gem dealer.

(2) With respect to an applicant for a pawn brokers license, the applicant provides to the City Clerk a bond of Five Hundred dollars ($500.00) with not less than two sureties, for the observation of all municipal ordinances relating to pawn ...
