Resolution relative to determination of Special Use Application to establish a Mr. Gyro Restaurant within a portion of unoccupied floor space within the Akash Mobil Building at 10537 W. Greenfield Ave. (Tax Key No. 449-9984-000)

Body

WHEREAS, Virenda S. Verma (the “Developer”) duly filed with the City Administrative Officer-Clerk/Treasurer an application for a special use permit, pursuant to Sec. 12.42(2) and Sec. 12.16 of the Revised Municipal Code, to establish a Mr. Gyros Restaurant (no drive-through) with outdoor dining at 10537 W. Greenfield Ave.; and,

WHEREAS, after due notice, a public hearing was held by the Common Council on July 5, 2005, at 7:00 p.m., in the Common Council Chambers to consider the application; and,

WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:

1. The applicant, Virenda S. Verma, d/b/a Akash Real Estate, Inc./Mr. Gyros, resides at 16225 Cumberland Trail, Brookfield, WI 53005.

2. The applicant owns the property at 10537 W. Greenfield Ave., West Allis, Milwaukee County, Wisconsin, more particularly described as follows:

All the land of the owner being located in the Northwest ¼ of Section 5, Township 6 North, Range 21 East, City of West Allis, Milwaukee County, State of Wisconsin, describes as follows:

East 220.00 feet of the West 736.25 feet of the North 136.24 feet of the Northwest ¼ of said Section 5, subject to the rights of the owners adjacent to the east, due to the overlapping deed description.

Tax Key No. 449-9984-000

Said land is located at 10537 W. Greenfield Ave.

3. The applicant is proposing to establish an approximately 1,122 square foot restaurant occupancy within the 3,480 sq. ft. gas station/convenience store building, and an outdoor dining area on site within a 30' x 8' (240 square foot) area.
