Resolution to transfer ownership, by Quit Claim Deed, of a City of West Allis property located at 9** S. 70 St. (Tax Key No. 440-0259-008), to the Community Development Authority of the City of West Allis.

Body
WHEREAS, authorized by Resolution No. R-2010-0243 on November 3, 2010, the City of West Allis (the “City”) purchased the property at 9** S. 70 St. (the “Property”) with Community Development Block Grant funds on December 1, 2010; and,

WHEREAS, the City has received a Letter of Intent from an interested developer for the purchase of the Property; and,

WHEREAS, the Community Development Authority of the City of West Allis (the “Authority”) acts as an agent, representing the City, in all forms of development, and after the transfer of ownership, would work with the interested developer on the sale of the Property; and,

WHEREAS, the City wishes to transfer the Property to the Authority, which would include all future maintenance expenses until the Property is sold to a private party; and,

WHEREAS, the City wishes to transfer the Property by Quit Claim Deed to the Authority for One Dollar ($1.00) and other good and valuable consideration; and,

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis as follows:

1. That the Common Council of the City of West Allis hereby transfers ownership of the property at 9** S. 70 St. by Quit Claim Deed to the Community Development Authority of the City of West Allis for One Dollar ($1.00) and other good and valuable consideration.

2. That said Property be under the jurisdiction of the City of West Allis for future maintenance and repair.

3. That the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the Quit Claim Deed, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate amb...
